The City of Philadelphia has threatened to sue city businessman Ori Feibush for trespass after he spent $20,000 of his own money to beautify a trash-filled city-owned vacant lot next to his business, without city permission.

As outlined previously in our Guerrilla Gardening & Trespass post, guerrilla gardening (gardening without owner permission on land that does not belong to you), is, by definition, a trespass. The city will easily be able to prove its case in court, because Mr. Feibush did not have permission to enter the vacant lot. However, considering the trashy condition of the lot before Mr. Feibush cleaned it up, bringing this case would likely be a public relations headache and wouldn’t achieve much benefit for the city or its taxpayers.
